These representations had not been approved by the Secretary of the Department of Health and, accordingly, the advertisements containing these restricted representations breached subsections 42DL(7)(a) and 42DLB(4)(a) of the Therapeutic Goods Act 1989 (Cth)(Act). </div> <div><br> Enquiries conducted by the TGA identified that the thermal imaging system was not entered in the Australian Register of Therapeutic Goods (ARTG) and was required to be because there was not any excluded goods determination applicable to it and it was neither the subject of an exemption, approval or authority under the Act nor an exemption, approval or authority under regulations under the Act.
