Alleged breaches of the Therapeutic Goods Act advertising provisions were identified where the TGA alleged that the advertised products were medicinal cannabis, schedule 4 or 8 substances under the Poisons Standard. As such the TGA considered the advertising breached subsections 42DL(10) and 42DLB(7) of the Therapeutic Goods Act 1989. The TGA confirmed that the advertised product (medicinal cannabis) was not entered in the Australian Register of Therapeutic Goods (ARTG) and was not exempt from the requirement to be included in the ARTG.
